Possession charges in Wisconsin are based on whether or not an individual has a prior marijuana possession offense. Possessing any amount of marijuana on a first offense is considered a misdemeanor offense. This kind of misdemeanor offense can earn a fine of five hundred dollars and up to six months in jail. Possessing any amount on a second or subsequent offense is considered a felony offense. This kind of felony offense is penalized through a fine of two thousand dollars and up to two years in prison.
Cultivation
All cultivation offenses in the state of Wisconsin are based on the number of plants in possession. All cultivation offenses are considered felony offenses. Cultivating between one and four plants is punishable by a fine of ten thousand dollars and up to three and one-half years of incarceration. Cultivating between five and twenty plants can earn up to six years in prison and a fine of ten thousand dollars.
Any individual cultivating between twenty-one and fifty plants can earn a fine of twenty-five thousand dollars and up to ten years of incarceration. Cultivating between fifty-one plants and two hundred plants can earn incarceration up to twelve and one-half years and a fine of twenty-five thousand dollars. All cultivations of more than two hundred plants will be penalized by fifteen years of imprisonment and a twenty-five thousand-dollar fine.

Sale offenses are based on the amount to be sold. All sale offenses in Wisconsin are considered felony offenses. Selling less than two hundred grams can earn a fine of ten thousand dollars and up to three and one-half years in prison. Selling between two hundred and one thousand grams is punishable by incarceration of six years and a ten thousand-dollar fine.
The sale of marijuana between one thousand and two thousand grams is penalized by twenty-five thousand dollars in fines and imprisonment of ten years. Selling between twenty-five hundred and ten thousand grams can receive a fine of twenty-five thousand dollars and imprisonment of twelve and one-half years. Selling more than ten thousand grams is punishable by a twenty-five thousand-dollar fine and no more than fifteen years of incarceration.
Other
Possessing any amount of marijuana paraphernalia is considered a misdemeanor offense that is punishable by a five hundred-dollar fine and no more than thirty days in jail. Selling marijuana paraphernalia is also a misdemeanor offense but is instead punishable through ninety days in jail and a fine up to one thousand dollars
Selling marijuana paraphernalia to a minor is a misdemeanor offense that can earn a ten thousand-dollar fine and up to nine months in jail. The state of Wisconsin currently has a no tolerance law for driving under the influence of marijuana and other drugs. Charges will follow any trace of marijuana in an individual’s blood while operating a motor vehicle.
