Idaho Felony

In the state of Idaho felonies are not classified by letter or number classes. Instead criminal offenses considered as felonies are defined based on statutory provisions of each offense. A portion of criminal offense listed as felonies are rendered their own predetermined prison sentences. Any criminal offense determined as a felony is subject to a minimum of 5 years imprisonment and fines of a maximum of $50,000.

The following are crimes considered as felonies in Idaho:

Murder: 1st degree: punishable by execution or life sentence.

Kidnapping: 1st degree: punishable by execution or life sentence.

Rape (male or female): punishable by minimum of 1 year to maximum of life sentence.

Drug related crimes: punishable by sentence of a maximum of 30 years; fines of no more than $50,000.

Human Trafficking: punishable by a sentence of a maximum of 25 years.

Robbery: punishable by sentence of a maximum of 25 years; fine of no more than $20,000.

Arson: 1st degree: punishable by sentence of a maximum of 25 years; fines of no more than $100,000.

Aggravated assault: punishable by sentence of a maximum of 5 years; fines of no more than $5000.

Driving while intoxicated: punishable by sentence of a maximum of 5 years; fines of no more than $5000.

Grand theft/larceny: punishable by minimum sentence of 1 year to maximum of 20 years; fines of no more than $10,000.

Aggravated battery: punishable by sentence of a maximum of 5 years; fines of no more than $5000.

Assault with intent: punishable by sentence of a minimum of 5 years to life sentence.

Battery with intent to commit serious felony: punishable by sentence of maximum of 20 years.

Burglary: punishable by sentence of maximum of 25 years; fines of no more than $20,000.

Crime against nature: punishable by sentence of maximum of 25 years; fine of no more than $100,000.

Domestic battery: punishable by sentence of maximum of 5 years; $5000.

Enticing of a child: punishable by sentence of maximum of 20 years; must register as sex offender.

Forcible Sexual penetration by use of foreign object(s): punishable by execution or life sentence.

Indecent exposure: punishable by sentence of a maximum of 5 years; fines of no more than $5000; must register as sex offender.

Intimidating a witness: punishable by sentence of 5 years; fines of no more than $5000.

Lewd conduct with a minor under sixteen years of age: punishable by sentence of minimum of ten years and a maximum of 20 years; fines no more than $20,000; must register as sex offender.

Sexual abuse of minor under sixteen years of age: punishable by sentence of minimum of ten years and a maximum of 20 years; fines no more than $20,000; must register as sex offender.

Sexual exploitation of minor under sixteen years of age: punishable by sentence of maximum of 20 years; fines no more than $10,000; must register as sex offender.

Felonious rescue of prisoners: punishable by sentence of maximum of 5 years; fines of no more than $5000.

Escape while convicted and/or on probation for felonious charge: punishable of maximum sentence of life.

Unlawful possession of firearm(s): punishable by sentence of maximum of life.

Voluntary manslaughter: punishable by execution or life sentence.

Assault with intent to murder: punishable by sentence of up life and/or execution.

Administering poison with intent to murder: punishable by life or execution.

Mayhem: punishable by sentence of a minimum of 5 years to a maximum of 25 years; fine of no more than $100,000.

Abuse of child during performance of ritualized ceremonies: punishable by sentence of a maximum of 20 years.

Cannibalism: punishable by life sentence or execution.

Manufacturing/deliver/possession controlled or counterfeit substances: punishable of sentence of maximum of 25 years; fines no more than $100,000.

Drug trafficking: punishable by sentence of a maximum of 25 years.

Threats against officials within any of three branches of government: punishable by a maximum of life sentence.

Unlawful discharge of firearm in occupied space (house, building, vehicle): punishable by sentence of maximum of 5 years.

Unlawful possession of destructive devices and/or bombs: punishable by sentence of maximum of life sentence if determined as terrorist act.

Attempt to conspire/solicit or commit felony crime: punishable by minimum sentence of fives years and maximum of 20 years: fines of no more than $50,000.

Expungement

Expungement is not possible in the state of Idaho. Individuals who are charged with a felony have the ability to petition the court at the time they are charged. This petition is only to attempt to avoid a felony charge based on particular case presented and circumstances of the crime. Filing the petition does not guarantee the accused will not receive a felony charge and/or conviction.
